Sega's hurting financially right now, and any decisions they make will be based on what they think will generate more profits, not what is best for the characters or story of an overseas comic*. If the misappropriation of the Aliens: Colonial Marines budget by Gearbox has taught Sega anything, it's to keep greater oversight on its partners.
*-For example, one of their only mandates that actually benefited the comic was requiring Sally to survive Endgame. Yet even this was because they wanted to keep merchandise possibilities available, not out of any consideration for the character.

Not only that, she was kept because she was a fan favorite and Sega likes having them in the comic (just not the games) though i remember reading something a long time ago that Yuji Naka always thought of putting them in the games

Rumors and evidence point to Sally almost getting into Sonic '06(Instead of Princess creepy. Some of the plot kind of makes sense now, doesn't it?), Sonic Generations, and a failed Sat-AM based project. I'm sure there's others I'm forgetting, but there's things out there about it.
As for the case, I'm still surprised that Penders actually thinks he could come out on top from this. Even if he wins, who would dare to buy anything he produces later on?

No, it not make sense to me. Since the start of develop Sonic 2006, Sonic Team focused on make a more realistic Sonic in a more realistic world. Put it on an human world and interact with humans like Sonic Adventure 1. Make Sally the princess of a human world have no sense. And make a furry world isn't on their plan.
Sally is not really a favourite character, only for those who love SatAM. I understand in this forum a lot of people talk about her, but the reality is that in other Sonic's forum, no one give a shit, she don't even get mentioned. Shadow is a true fan favourite character, because thanks to the fans, He have his own game.
Aaaaanyway,
I don't care about Penders. The first days was interesting, now is pretty bored

Back to the court case. I'm not sure why Sega's getting involved, since I thought the legal debate doesn't have much to do with them. (Yeah, there was that bit about Penders suing Sega over Sonic Chronicles, but that was largely a separate issue -- though of course whether Penders has any copyright on his work would obviously have bearing on that case.) I'm thinking it's probably to settle the issue of whether certain characters like the echidnas are derivative (which, let's face it, they are) and therefore Penders can't lay any claim on them so long as they're Knuckles knockoffs. If so, Penders might well just mess with the character designs like he should have in the first place until Sega is satisfied, and then it'd be back to an issue between Archie and Penders.

Sad, but true. That's the reason why you don't see Sega acknowledging the hand-held series anymore (Gamegear, Advance, ect.). The only hand-held game they seem to care about is "Sonic Rush", since it introduced Blaze the Cat to the franchise. Heck, its sequel "Sonic Rush Adventure" seems to have been forgotten as well.
But then again, there were some awful games released on the hand-held consoles as well (Sonic Labyrinth, Sonic Genesis), so maybe they want to distance themselves from those titles in order to keep a good reputation.
