"rchie Comics Managing Editor Mike Pellerito has responded to Ken Penders’s ownership claims to several past components of the Sonic series.
On the Comic Book Resources managed blog Robot 6, Pellerito says talks are underway with the legal team on how to respond.
“We have been in contact with our legal team and the claims by Ken Penders are completely false,” Pellerito told reporter Brigid Alverson. “We will be responding through proper legal channels.”
We said it was going to get ugly fast, and that’s exactly what’s happening. Missing from the melee so far is any official response from Sega–important because many fans wonder how Penders could create a side series using his alleged original characters without potentially infringing on company rights. It’s a complicated legal matter, and we hope to keep you clearly informed on it as best we can as it evolves."
It is amazing to why Mr. Penders thought this could be a good idea.

He did come to FUS a few years back and chatted a bit on the board. He was only here to help promote a few over expensive SatAM box-sets he was selling with his signature all over them.
Seriously though, I would quite happily pay to read his Locke comic - I thoroughly enjoyed Ken's work on the Knuckles series.

The way american comics are set up is pretty terrible from a creative standpoint, you don't retain rights to what you create. And growing up Penders basically WAS Sonic the Hedgehog the comic, the good and bad.
A nice side benefit of this is that at least for a little while Ian Flynn should have fewer great characters to ruin with his terrible writing.
Ian stole Pender's outline for what he was going to do with the series btw.

If you're throwing a hissy fit, you're being a douchebag.
Do you have any idea how messy things would be if it were normal to just hand out copyright to writers and artists? Imagine if you wanted to tell a Batman story and you had to get separate rights for Batman, Robin, and The Joker, to say nothing of anyone else or any plot elements you might use!
There is a very good reason why copyright gets assigned to the studio or publisher. In fact, whenever I start a collaborative project, I always make it clear that I will own the copyright to everything given to me. If you want to keep it, don't give it to me -- it's that simple.
Look, I may not like Ian, but Ian didn't steal shit. He used the outline and he was within his rights, buth legally and morally, to do so. Penders's work for Archie was work-for-hire, therefore Archie, including Ian, had the right to use it -- and that's the way it should be.
