That DNS took longer to propagate properly than I thought it would. *Now* we should be back for good, though.

Or it might be because Bluehost *finally* got around to that server wipe (one week after we'd asked for it) and that wiped out our DNS settings. I'm not sure which and I don't really care. In any case, we've severed our last ties with Bluehost, so this will not happen again.

Looks like Bluehost yanked our DNS since our hosting account expired. That's why the site went down a while ago. But as you can see, it's fixed now.

So, what he is summing up is every story, character.. EVERYTHING he ever did under ARCHIE and so on is fully copywrited by him and he plans to sue anyone using them.

Normally you think artists and writers for comics like this are.. Really just for hire. Doesn't really matter what they create, its their job. I am slightly curious to what triggered Mr. Penders to go phycotic on everything. I mean, there has to be a reason for it other then the mustache wanting more money right?

How does that even work, though? I mean, half the crap in Archie, half the crap that's EVER been in Archie, Penders or otherwise, was already created, either in SatAM or by SEGA. Heck, what about the other writers who contributed to Archie, like Karl Bollers? How in the world can Penders legitimately lay claim to damned near anything in Archie as "exclusively" his, given that complex web of creation?

Thats the problem with stuff like this. I would say ARCHIE owns everything, except the stuff SEGA has and lets them use. Doesn't matter who you are, if you are working for a company and your JOB is to create stuff... How do you go around and copywrite it?

Like working for a software company, being part of a team making a piece of software then going "Bitch, I'm copywriting this section!".


But yet at the same time... according to copywrite laws.. his claim is just if he copywrited it. Just kind of a odd situation. Mr. Flynn does say it is under controll, and I think ARCHIE has enough money and power to shrug this off as a "damn old guy is having his period again..". But then again, if anything did result in court.. I would be interested on the lawyer taking Mr. Penders case.


I guess we just wait and see what plays out, but I think Mr. Penders is about to get smacked down pretty hard. The mustache can only protect him so much.

I think it's even more weird that he thinks Lara-Su, Locke, Luger and company warrent enough attention to get their own spin off series.

Even Sally, in the peak of her popularity, couldn't get past 3 issues. And that was WITH a TV show, limited toy line, and a SEGA THEME PARK!!

I don't even see how a Luger or Legionnaire#129101 independent spin off series could get past issue 1, let alone make it to print.

Why can't he just focus all his energy into his original Lost Ones and other projects?

Well, without the restrictions of Archie or any other large company he could in sence make those characters have their own life. Start them off completly anew again and go from that. Why not just create a whole new character with similar style? Who knows. Maybe there is some sorta perverted attatchment here mellow.gif

Personally I thought when people wrote comics they brought all sorts of ideas from different people together. Or in other words they WORK together, no no no........THEY SHARE!!

This is like saying a star from a popular TV show quits and assumes they own the character that they played. So? The director will probably find another actor to play the same character anyway to keep the show going. The first star gets pissed, well tough! We're going to keep this character and keep the show popular!

This is also like a squabbling argument between brothers or sisters. "hey stop using my wii-mote"

"Because it is mine"
"You're not using it"
"So what, it is MINE!"
(Hmmmmmmmm, I see a connection here...)

I do not see DIC getting pissed because the comics have used Sally, Rotor, & Bunnie from SATAM. Why is this guy?

I'm not sure what leg ol' Penders thinks he has to stand on in all of this. It's a funny one. The only person Ken should be suing though is Mr Flynn for the disgraceful mess he turned the Echidna's story into. In fact, I would like to sue him myself for that. With fire.

Surely the basic echidna design will be recognized as a derivative work from Sonic the Hedgehog. Hence, such a thing is never gonna happen without Sega's permission, despite what Ken and his lawyer apparently think.

Exactly.. Locke is Knuckles' dad, and looks just like Knuckles with a beard. All the other echidnas' character designs are based on Knuckles'. Wouldn't selling comics about a bunch of Knuckles look-alikes be copyright infringement?
