Yeah I did get it. Came out nice. Kinda a neat read.

Should be a pretty open and shut topic I guess.  I remember having a discussion with someone over Deviant Art before about this and wonder if anyone here would know the specifics.

 

Long story short, I had created replacement characters for Ken Pender's parental figures for Sonic, and the backstory was so fitting for them that I thought even Sega would be impressed.  Not that I made them specifically for Sega to take them, I simply didn't care if they did, even without credit. 

 

I don't care enough to push the idea any further, but I am curious.  Someone told me there was legal this or that that would prevent a company from using unsolicited fan creations.  This true?  Can someone elaborate for me? 

 

What's the problem with using fan creations if unsolicited? 

 

If it is such bad practice, why did I hear Capcom had hired the team who were making an HD Res Evil 2 (or hell, why would Sega allow that Whitehead guy to make Sonic Mania, for that matter)?

Well, technically nothing prevents them from using them if you sign a contract with them. But they're probably not going to look at the submission in the first place.

The reason for that is because if, by pure chance, they create something similar, you can sue them for it. You can't really win the lawsuit unless you can prove they copied it, but they don't want to even deal with it. Writer Mark Evanier once gave an example of something like this: a fan submits to a sitcom's producers a script for an episode that takes place in a bowling alley. The producers read it, don't like it, reject it. Some time later a different writer comes up with a completely different idea for an episode that also takes place in a bowling alley, and the producers produce that one. The writer of the rejected bowling alley episode might sue even though the only element the scripts have in common is taking place in a bowling alley.

The situation with HD remakes of games is different because they don't really have any creative ideas that can be swiped anyway (the content belongs to the company in the first place). It also probably helped that the projects didn't arrive in the mail by some submissions process; they were on the web and fans were already talking about them.

Basically it's plausible deniability. 

 

The more they IGNORE or AVOID these kind of ideas, the easier it is to create something similar without people suing or game angry.  

 

Or rather, the easier it is to win a court case about it.

Sounds about right.  At this point I'm just looking for specific things to better my understanding.

 

 

Like, wouldn't PR go through the roof if they were to incorporate some fan creatiosn?  They could make a public announcement that they can't accept all ideas, or something to that affect, to stop the floodgates from opening, or at least downsize it. 

 

There's a lot of people who would probably work for cheap or even free, lawsuits don't even need to ever be thought about, so long as a signature is gotten and everyone is in agreement prior to release.

More often than not it's the incident of "You used somebody else work but not mine!  WAAAAH!" rather than the "You used my work, I'll sue!" stuff.  Rather than deal with any of it, companies avoid it.

 

That said, the Comic Book Character Venom was a fan creation that Marvel bought from the Creator.
