I think for Lost Hedgehog Tales its less the characters and more taking script material Archie has copyright ownership over that Ian Flynn might get in trouble if he releases it on his own.

 

True, but it seems odd that certain characters which SEGA should technically own are restricted from use by legalities. Who else would claim partial ownership of them if not Archie?

I really doubt it's Penders; not after all the crap he caused.

 

I was referring to the Post-Reboot elements and the SatAM cast. Ian has confirmed that he and the other creators involved had signed over the rights of their creations to SEGA/Archie, but now that SEGA is no longer partnered with them and said elements are currently in legal limbo, it seems as though Archie might've retained some control and is preventing that material from channeling over.

 

At least, that's my best guess.

To be honest, I don't know the reason either. All that we do know, though, is that IDW cannot continue the Archie Reboot continuity or reprint any of the issues despite the license being shifted to them. It's possible any original and exclusive content formally associated with them was also prevented for the exact same reasons.

 

It's especially baffling given that, as you said, the material is practically useless without SEGA's license. But if Archie has somehow retained partial ownership of them and cannot do anything with them without SEGA, then they're pretty much in limbo at the moment.

 

But if, say, SEGA decides to purchase them to transfer over to IDW or they're waiting for the permits to expire, we could see something come about. But that's only guesswork. We don't really know the direct cause of all this is.

Could be artist copyright. Certain countries do have laws that state the image goes back to the artist when ownership runs out.

I'm pretty sure Ian said that they signed the rights of their creations over to SEGA/Archie.

I'm sure they did but I imagine the fire that Archie HQ had destroyed those documents along with the Penders file. Hence the scrapping of all in house Archie characters for their reboot to avoid a future lawsuit.

Well, it's not really the pre-reboot characters that fans are concerned about, it's the reboot and SatAM characters.

The only thing I can really think of is that SEGA wants to start with a new, clean slate with IDW and not want anything to do with Archie's run, primarily the last few years.

 

In theory, Archie could make something with the Post-SGW characters as their own standalone comic, but who would honestly purchase that if it didn't have a hook like Sonic.

 

I would think SEGA is waiting for time to expire or drive the price down to fully transfer it over to them/IDW. At the same time, I'm curious if Archie is trying to convince SEGA to do one last "super issue" that covers post SGW to the end and close lose ends but now, nearly 2 years later, seems highly unlikely.

That's probably it in a nutshell.  Test the waters with the "official" group and expand later.  

 

Honestly it's how IDW handled Ninja Turtles, Transformers, GI Joe, and others.

I'm just hoping SEGA's lenient enough to allow Ian and the other creatives some artistic room to further develop the series with what little elements they have available at the moment. Given how strict they were with their official characters during Archie's run, the exclusive/neglected characters were a welcome addition since they weren't so limited by their constraints.
